The Verkhovna Rada adopted a presidential law on ratification of the Agreement between Ukraine and the Democratic Socialist Republic of Sri Lanka on extradition (No. 0113). For this decision voted 261 MP of 338 registered in the session hall, UNIAN reports.
Law on ratification of the agreement signed on 25 June 2016 in Kiev, which comes into force on the 15th day after the date of exchange of instruments of ratification.
Agreement the parties undertake at the request and in accordance with its provisions and its laws to extradite to each other persons on their territories for criminal prosecution or for sentence.
It is noted that this follows if the act for which extradition is requested is an offence under the legislation of both parties.
The results with the purpose of criminal proceedings against the person are carried out for crimes for which the laws of both parties punishable by imprisonment not less than one year or a more severe punishment.
The results for the execution of the sentence is made, if the person whose extradition is requested, is left to serve a sentence of at least six months at the time of receipt of the request.
This establishes that extradition should be refused in particular if the offence for which extradition is requested is of a political nature; the requested party has substantial grounds for believing that the extradition request made for the purpose of prosecution or punishment of a person in connection with his race, religious confession, nationality or political beliefs, or what position that person can deteriorate with any of these reasons; the person whose extradition is requested is a citizen of the requested party.
In the application of this Treaty to political crimes not considered murder or attempted murder, causing or attempting to cause physical harm to the head of state or head of government or any member of their families; offences related to terrorism; any offence specified in an international Treaty which participants are both parties, and which obliges them to prosecute or extradite for such a crime.
If the offence for which extradition is requested, under the laws of the requesting party are punishable by the death penalty, and for the same crime by the law of the requested party is not punishable by the death penalty, extradition is denied, unless the requestor does not provide guarantees that the requested party considers sufficient that this penalty will not be applied.
This agreement is concluded for an indefinite period.
