Ukraine has accused member countries of the Eurasian economic Union (EAEU) Armenia, Kazakhstan, Kyrgyzstan and the Russian Federation in the systematic violation of the norms and rules of the world trade organization (WTO) in the course of conducting anti-dumping, anti-subsidy and special safeguard investigations, seeking an end to vicious practices.
As reported in the press release of the Ministry of economic development and trade Wednesday, the questions of violations of WTO rules in the conduct of investigations by the EAEU Ukrainian delegation has paid the most attention to during the meeting of the WTO Committee on anti-dumping practices held on 25-28 April in Geneva.
«In his statement, Ukraine drew the attention of member countries of the WTO on the systematic violation of the EAEU of WTO rules when conducting anti-dumping investigations, leading to the use of legally and economically unjustified restrictions on access of Ukrainian products to the markets of the five countries (in addition to the above, and even Belarus, which has observer status in the WTO). The Ukrainian delegation informed that the anti-dumping investigation concerning the import into the territory of the EAEU of bars, manganese and steel pipes originated from Ukraine held in violation of several provisions of article 2 (determination of dumping), 3 (determination of injury) and 5 (procedure for initiating and conducting investigations) of the WTO Agreement on the application of article VI of the GATT 1994 and the GATT», — stated in the message.
It is noted that during the meeting the Ukrainian delegation has put forward Armenia, Kazakhstan, Kyrgyzstan and the Russian Federation the demand to abolish the decision of the EEC on the anti-dumping measures on the bars, to terminate the investigation with respect to the crops without restrictions and to terminate the review of anti-dumping measures on steel pipes without prolongation of their action.
During the meeting, the representatives of the countries-members of the Union did not provide explanations to Ukraine raised questions and noted that he would provide answers in writing in the near future.
During the meeting the Ukrainian delegation also appealed to the Pakistan about the conduct of anti-dumping investigation against cold-rolled steel, including originated from Ukraine. In a statement the Ukraine pointed to the illegitimacy of the use by Pakistan of the provisional anti-dumping measures in the absence of damage to the Pakistani industry, which is contrary to the provisions of article 3 and 7 of the Agreement on the application of article VI of the GATT 1994.
In addition, in the framework of the WTO Committee on safeguards, a set of issues was addressed in India regarding the conduct of security investigations and their failure to comply with the basic provisions of the WTO agreements, in particular concerning metallurgical products. Ukraine has called on India to abolish the restrictions and to abandon the practice of application of protection measures not on facts but on calculations of predictive performance.
We will note, the Board of the Eurasian economic Commission on 29 March decided to impose anti-dumping duty on Ukrainian bars for a period of 5 years, including the occupied territories of Donbass.
In particular, Enakievo metallurgical plant installed an individual fee at the rate of 10,11% of the customs value; for «ArcelorMittal Kryvyi Rih» is the individual duty of 9.32% of the customs value. For all other manufacturers, the duty will amount to 10,11%.
In addition, the Eurasian economic Commission has re-opened an anti-dumping investigation against certain types of steel pipes from Ukraine.
