Bill No. 1630 provides for liability for illegal disposal of collected, treated, prepared by the journalist of materials and technical equipment which the journalist enjoys during their professional activities.
For this decision on Thursday 4 February voted 240 deputies, reports Еспресо.TV.
MPs amended article 163 of the Criminal code of Ukraine.
Due to changes of voters, violation of the secrecy of correspondence, telephone conversations, Telegraph or other correspondence that was committed against journalists, it is expected criminal penalty of deprivation of liberty for a term of three to seven years.
Lawmakers rewrote the article 171 of the Criminal code.
Its laid out as follows:
Illegal disposal of collected, treated, prepared by the journalist of materials and technical means which he uses in connection with his professional activities, the unlawful denial of access of journalist to information, illegal prohibition of coverage of particular topics, screening of individuals, criticism of the subject of authority, as well as any other deliberate interference with the exercise of the lawful professional journalist’s activity is punished by a penalty to fifty free minima of the income of citizens or arrest for up to six months, or restraint of liberty for a term up to three years.
Influence in any form on the journalist for the purpose of preventing the discharge of professional duties or their persecution of the journalist in connection with his lawful professional activities – shall be punished by a fine of up to two hundred tax-free minimum incomes, or arrest for up to six months, or restraint of liberty for a term up to four years.
The actions specified in part two of this article, if committed by an official using his official position or on preliminary arrangement by group of persons — shall be punished by a fine from two hundred to five hundred tax-free minimum incomes, or restraint of liberty for a term up to five years, with disqualification to hold certain posts or practice certain activities for a term up to three years or without such.
We will remind, on may 14, 2015 the Verkhovna Rada adopted the law «On amendments to some legislative acts of Ukraine regarding strengthening guarantees of legal professional activity of journalists» (registration No. 0924). This act, the criminal code is supplemented by article 3451 «Threat or violence concerning the journalist». It provides that threats of murder, violence or destruction of, or damage to property against the journalist, his close relatives or family members in connection with this journalist’s legitimate professional activities is punishable by correctional labor for a term up to two years or by arrest for a term up to six months, or restraint of liberty for a term up to three years, or imprisonment for the same term.
