Russian tax authorities have brought a new challenge to the Lipetsk factory «Roshen» — «daughter» of Ukrainian Corporation Roshen, owned by the President of Ukraine Petro Poroshenko. On 3 February 2016 reports «Interfax-Ukraine».
As follows from materials of arbitration court of Lipetsk, Interdistrict Inspectorate of Federal tax service (FNS) on the largest taxpayers in the Lipetsk region sent the factory a request for payment of the tax (gathering), corresponding fines and the penalty and interest in the total amount of 374 million 818,76 420 thousand rubles (as of 14 January 2016).
In turn, the factory has addressed in arbitration court with the claim about a recognition illegal decisions of the tax authority and asked the court to issue interim measures.
Having reviewed the evidence, particularly the Declaration of the factory for the profit tax for the 11 months of 2015, the report on financial results for 2014 with the stated amount of the loss in 407,267 million rubles, «the court concluded that the penalty assessed by the tax authority appealed the decision of the amounts can cause the factory considerable damage,» according to the court records.
The court took into account that in December 2015 inspection prohibited without the consent of the tax authority to alienate (to pledge) the property factory for the sum of 373 656 million 853 thousand roubles. Then the court banned the Interdistrict Inspectorate to carry out the undisputed collection from the factory of the assessed amounts before the entry into force of the judicial act for appeal against the decision of the Inspectorate.
Meanwhile, there is an ongoing dispute between the factory and the tax inspection regarding the claim of tax specialists on 361,5 million. After passing the relevant judicial authorities, the factory filed a cassation appeal. The arbitration court of the Central district has scheduled the examination on 15 March 2016.
According to the BBC, the Lipetsk factory for the last three years have listed to the Russian budget «a little more than a billion rubles (about 330 million)».
