The police had no right to shoot at the BMW on the move.

During a chase by patrol officers in Kiev in the SUV BMW, which ended in the death of the driver, the police committed a number of violations. In particular, the patrol had no right to shoot cars on the go. On Thursday, February 11th, the Minister of internal Affairs Arsen Avakov.

«We now inspect. During the investigation the police will be removed from service. The test will be conducted by the Prosecutor’s office and internal security service. We fix the number of violations. For example, regulations prohibit shooting. We had to stop. And it causes certain questions», – said Avakov in the air of «1+1».

The Minister also called the death of the driver of the SUV «hurtful and very negative.»

«We’re sorry that it happened. However, it is also true that the police will always stop aggressive methods of disobedience», – he stressed.

«When the car is going at a tremendous speed through the city, does not stop on police orders, does not respond to the signals that will be applied the weapon. The police is not in the hands and in the eyes of the cameras, they can’t see who inside the car – the young, the terrorists or anyone else. This is a problem that can bring death», – said Avakov.

As reported, in Kyiv on the night of 7 February a patrol police during the prosecution of the violator of the rules of the road and opened fire on the car, resulting in death 17-the summer passenger of this car.

Head of patrol police of the capital Yuri Zozulya stated that the patrol acted lawfully and perform their direct duties — ensured the safety of citizens. According to Zozulya, the car with the offenders did not react to any instructions of the patrol to stay or exit the car, the driver of the car violated traffic rules, endangering other people, in particular, was moving in the opposite lane.

The Moscow Prosecutor’s office opened on this fact criminal proceedings under part 3 of article 365 UK of Ukraine (excess of authority or official powers that caused grave consequences) and checks the legality of actions of employees of the patrol police.

We will remind, the patrol police is authorized in exceptional cases to use firearms to stop a vehicle by damaging it if the driver by his actions endangers the life or health of people and/or police.
