According to the new law «On the legal status of the hostages deprived of their liberty and convicted prisoners at the temporarily occupied territories of Ukraine and abroad,» No. 8205 of 27 March, the legal status of detained persons in the occupied territories of Ukraine and abroad will determine the security Service of Ukraine.
It is assumed that the Ukrainian secret service will issue a document that the person was unlawfully deprived of his liberty. In addition, must be issued a special certificate «for victims of unlawful deprivation of liberty».
According to the law, persons with such documents shall have the right to legal assistance from the state, as well as to health care. Responsible for service delivery should be determined by the government of Ukraine. In addition, illegally incarcerated people will be eligible for social housing, monetary compensation from the state for the period of stay in captivity, the minimum wage per month, a deferment of payments on loans, exemption from penalties and restoration work on the former.
If the person was illegally convicted in another state, the Ukrainian government will help him with legal aid in a situation with his appeal for compensation.
Among the authors of the bill the first Vice-speaker of the Verkhovna Rada Iryna Herashchenko, people’s deputies from the Radical party, Oleg Lyashko and Yuriy Shukhevych, from the bloc of Petro Poroshenko Iryna Lutsenko, from the «people’s front» Maxim Bourbaki, independent MP Andrew Biletsky.
27 December 2017 in the Donbas had an exchange of detained persons. According to the Prosecutor General, Ukraine then traded 233 detainees at 73 Ukrainian hostages.
