The court refused the request of MPs to oblige, to propose the candidacy of the Minister of health

The district administrative court of Kyiv denied the extra fractional people’s Deputy Andriy Derkach, as well as MPs from the «Batkivshchyna» Valery Dobilu and Yuri Odarchenko of the claim to the Prime Minister of Ukraine Volodymyr Groysman on the failure to make its views on the appointment of the Minister of health. On it informs a press-service of the court.

«The court proceeded from the fact that the primary actor in the process of formation of a new Cabinet is a coalition of Deputy factions. It makes proposals to the President on the nomination of the Prime Minister, and in accordance with the Constitution, proposes candidatures to the Cabinet of Ministers of Ukraine. This mechanism implements the procedure of forming the composition of the Cabinet, and any failure to observe it contrary to the Basic law», – stated in the message.

It is noted that in the Constitution of Ukraine and the law «On the Cabinet of Ministers of Ukraine» is not established due date for the Prime Minister to the Verkhovna Rada of ideas about the appointment of Ministers, including the Minister of health.

The plaintiffs asked to recognize illegal the inactivity of the Prime Minister due to the fact that he had not submitted to the Parliament representation about appointment of the Minister of health. The deputies asked the court to oblige the help to do it.

Acting Minister of health from July 2016 is Suprun.

Derkach, Dubil and they filed a lawsuit to Groysman on 6 October.

«Groysman – discoverer of the formula, as to appoint one of the key positions in the government of man and not coordinate it with the Verkhovna Rada», – said Derkach, referring to stay Ulyana Suprun in the role of acting head of the Ministry of health from July 2016.
