The coalition formally still exists, but in fact it disintegrated – Lutsenko

The head of the faction «Block of Petro Poroshenko» Yuriy Lutsenko says the actual collapse of the coalition, which formalized the statement of the faction «Samopomich» to withdraw from the parliamentary majority.

«In fact we have, perhaps not legally, but in fact, the death of the coalition, not today but a week ago.» The statement «Samopomich» today, frankly, is not something new. It simply formalized what we all knew for the last two weeks,» — said Lutsenko on Thursday, February 18, reports «Interfax-Ukraine».

After the release of «Samopomich» the coalition will cease to exist. If within 30 days there will be no new – to appoint elections to the Parliament

According to Lutsenko, the coalition of deputies as much as it was until now, because «a coalition is formed by the personal signatures of people’s deputies under the coalition agreement».

«As far as I know, no one member of its (signed) has not yet been recalled. Even after the statement of the Radical party about the coalition… no Lyashko, nor its associates signature was not revoked», he added.

As reported, on 27 November 2014 five factions created in the Verkhovna Rada of Ukraine VIII convocation adopted a decision on creation of the parliamentary coalition. In the parliamentary majority included the faction «Block of Petro Poroshenko», «Popular front», Association «Samopomich», the Radical party of Oleh Lyashko and «Batkivshchyna».

In the «Block of Petro Poroshenko» has declared that will not withdraw their signatures under the coalition agreement, however stated the actual collapse of the coalition. The leader of the faction Yuriy Lutsenko said that the faction of the Radical party may again become a full member of the coalition, Recalling that his signature under the coalition agreement Lyashko still has not withdrawn, and noting that there are no conditions.

On February 17 Prime Minister of Ukraine Arseniy Yatsenyuk said about the negotiations with the different political forces in Parliament, including deputies from the Radical party, for the purpose of reformatting of the government and update the coalition agreement.

As a result of the exit of the faction «Samopomich» from the coalition in the Verkhovna Rada of Ukraine in the composition of the parliamentary majority remain only the faction «Block of Petro Poroshenko» and «popular front» with a total population of 217 people’s deputies.

According to article 83 of the Constitution of Ukraine, the coalition of Deputy factions in the Verkhovna Rada of Ukraine shall consist of a majority of people’s deputies of Ukraine from constitutional composition, that is 226 or more.

Thus, according to the Basic law, the activities of the coalition in the Verkhovna Rada will be deemed terminated after the deputies of all factions, announced the withdrawal from the coalition of the Radical party and «Batkivschyna» and «Samopomich» will withdraw their vote from the coalition agreement. After that, according to article 83 of the Constitution, the new coalition in the Verkhovna Rada must be formed within one month from the date of termination of the old coalition.

According to article 90 of the Constitution, if within one month the Verkhovna Rada have not formed a coalition, the President has the right but not the obligation, to early terminate the powers of the Ukrainian Parliament. Such a decision may only be taken after consultation with the Chairman of the Verkhovna Rada, his deputies and the chairmen of the factions. After that the head of state, in accordance with article 77 of the Basic law, within 60 days, appoint extraordinary elections to the Parliament.

At the same time, if the faction of the Radical party, which had previously voiced his intentions to return to a parliamentary coalition and now counts 21 members, joins the existing coalition, the total number of coalition members in the «Block Poroshenko», «Popular front» and the Radical party reaches 238 people’s deputies. This is sufficient for eligibility of a coalition of Deputy factions.
