The beating of students on Maidan: the court left prosecutors and some victims explained the reasons for the slow investigation

The Shevchenkovsky district court of Kiev dismissed the petition for disqualification of the panel of prosecutors on the case of beating students on the Maidan November 30, 2013, which stated one of the lawyers of the victims Oleksandr Bashuk.

The judge of Shevchenkovsky regional court Elena Meledak noted that satisfaction of this petition was not submitted sufficient arguments, informs UNIAN.

She also reported that the next hearing on this case will begin on 11 January next year at 10.00.

This is quite a long recess, the judge explained that the criminal division of the court moved to another building on Church street.

In addition, the judge added that the next meeting will decide on the petition to change the measure of restraint for four ex-«berkutovets». A petition was filed by the defense due to the fact that several consecutive meetings, the accused did not appear for court and did not provide relevant medical certificates.

We will remind, the Shevchenkovsky regional court of Kiev considers criminal proceedings against the former «berkutovets» Andrew Diduca, Nicholas only site, Eugene Antonov and Yuri Shevchenko.

They are accused of illegal obstruction of organization or holding of demonstrations (article 340 of the Criminal code of Ukraine) and abuse of power (article 365 of the CCU) 30 Nov 2013 when was the forceful dispersal of students on independence square in the capital. Today, 14 December, the lawyer of victims on the case about the beating of students on Maidan Bashuk said the withdrawal of the group of prosecutors, accusing them of bias.

According to Basuki, prosecutors are biased and contribute to the protection of the accused.

Head of the Department of special investigations of the Prosecutor General Sergei Gorbatyuk visited the victims in the case about the beating of students on Maidan on 30 November 2013 and explained why the case is being investigated for so long.

The meeting was held in the courtroom of Shevchenkovsky district court of Kiev where injured in protest against delaying the case actually lived for two weeks.

The numerous questions about the delay in the investigation of the case about beating of students Gorbatyuk noted that there are several reasons. In particular, according to him, downsizing of the Department, conducted this fall, has led to the fact that instead of three investigators engaged in only one. Another reason is a large queue at the peer institutions for the conduct of a particular examination.

In addition, Gorbatyuk noted that often the courts do not contribute to the efficient result because of this matter and others. He gave an example, when the first Appellate court of Kiev released from-under guards under house arrest «berkutovets» Alexander Belov, who is suspected of killing three people on February 18, 2014 in Castle lane, and just yesterday the Pechersky district court of Kiev, despite the increase in charges Belova, did not satisfy the motion of the Prosecutor about taking him into custody and left house arrest.

Another reason for the slow movement of the case Gorbatyuk called the position of the interior Ministry leadership, which is unwilling to remove from their posts of law enforcement despite the serious allegations made to them by the Prosecutor. As said Gorbatyuk, it is even so that the prosecution is seeking the removal of law enforcement officers from office through the court, and their leadership in appeal cancels such suspension.

He also said that the leadership of the Ministry of interior could attract at least to a disciplinary responsibility of persons who are suspected of crimes against the Maidan, however, does not.

In addition, Gorbatyuk told the victim that he would support the idea of bringing criminal proceedings against the former head of the public security Department of the Main Directorate of the interior Ministry in Kiev Oleg Marinenko with the case of four ex-«Berkut officers», as soon as it Marinenko will be submitted to the court.
