Schegolev has left detention, but the court refused to appoint to consider the merits of the case

The Shevchenkovsky district court of Kiev decided to send to the court of Appeal of the capital to determine the jurisdiction of criminal proceedings on charges of crimes against activists of the Revolution of dignity, the former chief of USBU in Kiev and Kiev region Alexander Shchegolev, but left him in custody until 24 April.

The relevant operative part of the resolution announced by the presiding Board of the Shevchenko district court of Kyiv Oksana Golub, UNIAN reports.

Thus, the court dismissed the petition of the Prosecutor General to appoint a date for a hearing on the merits and at the same time having satisfied the corresponding petition of protection Shchegoleva.

As reported, on February 16, the General Prosecutor’s office of Ukraine sent to court the indictment against former head of the SBU in Kiev and Kiev region Alexander Shchegolev for organizing the violent dispersal of the Maidan on February 18-19, 2014.

On suspicion of involvement in the killings in Kiev in the winter of 2013 — 2014 have already arrested two senior leaders of the security service of Ukraine (SBU) and the three heads of militia of special forces «Berkut».

October 15, the Office of special investigations of the Prosecutor General of Ukraine jointly with the security Service of Ukraine detained one of the former regional commander of one of special forces «Berkut». He informed about the suspicion of «organizing the abuse of power their subordinates during the events of 18 February 2014 on Hrushevskoho street and Krepostnoy lane in Kiev and committing their crimes against protesters, which led to the occurrence of serious consequences» (part 3 of article 365 of the criminal code of Ukraine).

All of the above persons are waiting for the court verdict. The trial of their cases continues.

According to the head of the MIA of Ukraine Arsen Avakov, in General, for crimes against Euromaidan involved or are already involved in «more than 120 people» from various law enforcement agencies. The Minister promises to soon provide to the public their complete list, with indication of the positions these individuals occupied and also articles of the Criminal code, type and term of punishment provided him.

As for the prospects of criminal prosecution of the top officials of the regime of Viktor Yanukovych and, in fact, the ex-President, the government of Arseniy Yatsenyuk already
twice he applied to the international criminal court (ICC) on the recognition of the action of the Rome Statute for the recognition of the Court’s jurisdiction in respect of war crimes committed on the territory of Ukraine in the winter of 2013 — 2014. Only in the case of Ukraine’s accession to the Rome Statute will be possible to involve someone from former officials to criminal prosecution as a war criminal and demand that another country (where, say, a suspect might be hiding) issued to the ICC.

A final ICC decision is still not accepted, specially assigned Affairs of Ukraine, the Prosecutor of this court continues to study the situation.

The first order was submitted on April 17, the second on 29 September.
