«Samopomich» wants to temporarily «isolate» the occupied territory

In the faction «Samopomich» considers unacceptable the proposed changes to the Constitution on decentralization and advocate for temporary isolation of the occupied territories.

The head of fraction Oleg Berezyuk during the meeting with co-rapporteurs of the PACE monitoring Committee Huxley Jordi and Axel Fischer stated that the amendments to the Constitution on decentralization is not acceptable because «the special status of Donbass» and enclosing them in «usurpation of power by the President.»

«Fraud by amending the Rules regarding the constitutional process discredits any changes to the Constitution, because the social contract concluded through fraudulent means, will not be accepted by the people, the only source of power», — informs the press service of the party following the meeting.

«Temporary isolation of the occupied territories is a necessary prerequisite for economic, social and political stability of the state. Only a strong state Ukraine can provide further liberation and the return of Donbass», — stated in the message.

Berezyuk also stated the need for a new Prime Minister and Cabinet, as the current government, in his opinion, does not meet the standards of public administration that proved how the process of adoption and the content of the budget in 2016.

Recall, August 31, 2015 the Verkhovna Rada adopted in the first reading amendments to the Constitution. In its transitional provisions were made paragraph 18, according to which the peculiarities of local government in certain districts of Donetsk and Lugansk regions «are defined by a separate law». At the same time, the paragraph does not specify what law of Ukraine regulates these features, and the item is temporary in nature, as it refers to the transitional provisions of the Constitution.

Before that, on September 16, 2014, pursuant to the Minsk Protocol of 5 September 2014, the Verkhovna Rada adopted the law «On special order of local government in certain districts of Donetsk and Lugansk regions» (No. 2378). It provided, according to the 1st article of the law that the arrangement would be for three years. And 10 article suspends the articles 2-9, which describes a special procedure of local self-government ARDLE, up until in these territories, new elections and the formation of new governments.

So, on March 17, 2015 the Verkhovna Rada supported the presidential bill on amendments to article 10 of the law «On special order of local government in certain districts of Donetsk and Lugansk regions», which provides that a special procedure in certain districts of the Donbas must be entered after the early local elections.

Also, the Ukrainian Parliament adopted a resolution on the recognition of individual territories of Donetsk and Luhansk regions occupied.

January 20, the constitutional Court of Ukraine received a representation 51 people’s deputies of Ukraine concerning official interpretation of provisions of article 155 of the Constitution of Ukraine «at the next regular session of the Verkhovna Rada of Ukraine» in the context of the adoption of amendments to the Constitution in terms of decentralization.

Thus MPs are trying to postpone the final vote on the so-called «special status» of Donbass.

On 24 January the Prime Minister Arseniy Yatsenyuk said in favour of holding the referendum on amendments to the Constitution of Ukraine.

In turn, the Chairman of the Verkhovna Rada Volodymyr Groysman expressed the view that the status of Donbas as part of Ukraine should not be voted for at the referendum.
