In the presidential administration of Ukraine hopes that in the spring of 2016 Parliament will support the bill on amendments to the Constitution in terms of justice and three months after the successful vote, these changes start to be implemented.
«I hope that in the spring of this year, this vote (for the bill on amendments to the Constitution in terms of justice – ed.) will take place», — said the Deputy head of the presidential administration Alexei Filatov, «Interfax-Ukraine» on Thursday.
Responding to a question about whether, in his opinion, voting for amendments to the Constitution in terms of decentralization to follow after the adoption of the amendments to the Constitution in terms of justice, Deputy head of the AP said: «I Think that these are parallel processes, which are not very dependent on each other.
According to him, will soon be voted on the whole bill on amendments to the Constitution in terms of justice, will depend on coordinated work of the Verkhovna Rada.
Speaking at the public forum on the future of constitutional reform of Ukraine, Filatov said: «over the next few months we must make every effort to build consensus around this project and to achieve effective voting in the Parliament».
«If it (the adoption of amendments to the Constitution in terms of justice, the Parliament – ed.) happens, within three months from the moment of the vote, if successful, the constitutional change in terms of justice will come into force,» he added.
According to Filatov, it would mean significant progress of Ukraine towards the realization of goals such as de-politicization of ensuring the independence of the judiciary, greater accountability of judges, it will also lay the Foundation for the principles of the reform of the judiciary.
As is known, the constitutional Court gave an opinion on compliance with the requirements of articles 157 and 158 of the Constitution of this bill.
On 26 January the President of Ukraine introduced a revised version of the bill, which confers on Parliament the right to Express distrust to the Prosecutor General and send him into retirement. In the previous version of the document, the Parliament was deprived of this right.
The bill contains provisions on the elimination of judicial immunity, the automatic resignation of the judge in case of failure to perform the recertification, will also greatly increase transparency in the selection of judicial personnel and significantly increases the accountability of judges for making unjust decisions.
After receiving the output of the COP, the pre-Parliament approves a bill (first reading) a minimum of 226 votes. Finally, the law on amendments to the Constitution of Ukraine adopted at the next session of the constitutional majority of votes (at least 300).
The President of Ukraine Petro Poroshenko expressed hope that the Parliament by 2 February will vote in the first reading the bill on amendments to the Constitution of Ukraine in part of justice, «and in the spring – early summer» in the country could begin «the process of renewal of judicial branch of power».
On 2 February, the Verkhovna Rada approved the bill «On amendments to the Constitution of Ukraine (regarding justice)». For this decision voted 244 of 356 MPs registered in the session hall.
Rada will adopt amendments to the Constitution on justice in the spring and implementation will begin in the summer, hopefully in the PA 04.02.2016
