Accused of the murder of journalist Georgy Gongadze , the former chief of the Department of external supervision of the Ministry of internal Affairs Alexey Pukach can win the case in the European court of human rights. This was during a session of the court declared the lawyer Andrei Fedur, who represents the interests of the now deceased mother of Georgy Gongadze, Lesya, passes the Censor.NO.
«If Pukach will find specialists have the qualifications, then he has every chance to win the case in the European court of human rights,» said Fedur.
He explained that the case of Pukach had to listen to a jury, not a panel of judges. Besides, said Fedur, for all years of the investigation and the courts were not the motive.
«The trial of Pukach were not fair and the verdict is not lawful on the episode of the murder. It was judged the jury. The prosecution has not been formulated. In fact, it was about the wanton murder. We have a unique case — for thirty years I have never encountered that premeditated murder was without motivation,» — said the lawyer.
Fedur recalled that he proposed to send the case for additional investigation. However, after the verdict, Pukach Lesya Gongadze has decided not to challenge it.
The lawyer also said that it would not continue to participate in the process due to the fact that Lesya Gongadze died in 2013.
The journalist Georgiy Gongadze disappeared in Kyiv on 16 September 2000. In November of the same year in the wood of Kiev region was found decapitated corpse, which, on conclusions of experts, could belong to the journalist. In 2009 in the Kiev region were found remains of a skull, which at the request of the state office of public Prosecutor, belong to Gongadze. However, the body for a long time did not betray the earth as the mother of the journalist Lesya Gongadze refused to recognize that the found remains belong to her son.
In 2008, three former police officers — colonels Valeriy Kostenko and Mykola Protasov, and major Oleksandr Popovych — were found guilty in the murder of a journalist and sentenced to 12 (Kostenko and Popovych) and 13 years (Protasov) imprisonment.
The ex-the chief of Department of external surveillance of MIA of Ukraine Oleksiy Pukach long been wanted in connection with involvement in the murder of the journalist, until July 2009 not were detained in the Zhytomyr region. Since that time, Pukach remains in custody. The Prosecutor General’s office in December 2010 announced the completion of the investigation of the criminal case against Pukach in the murder of journalist Gongadze.
The consequence established that Pukach committed murder of the journalist on the instructions of Minister of internal Affairs of Ukraine Yuriy Kravchenko, who was found dead on March 4, 2005 at his home near Kyiv with two gunshot wounds to the head. On the eve of the ex-Minister was summoned for questioning in the murder of Gongadze. In 2005 the Prosecutor General’s office acknowledged the death of Kravchenko’s suicide and made the decision to close the criminal case.
29 Jan 2013 the Pechersk district court of Kiev sentenced ex-the head of Department of external surveillance of MIA of Ukraine, Pukach to life imprisonment, having recognized guilty in the murder of journalist Georgy Gongadze. Pukach was stripped of his rank of Lieutenant-General, and is obliged to pay the wife of journalist Miroslava Gongadze 500 thousand UAH, and UAH 100 thousand — another victim, a journalist Oleksiy Podolsky.
