Poroshenko vetoed the law on privatization of housing in dormitories

The President of Ukraine Petro Poroshenko has returned on repeated consideration in the Verkhovna Rada of Ukraine the law «On amendments to some legislative acts of Ukraine on securing implementation of housing rights of residents of hostels», according to the official website of the President on Friday.

The report notes that Poroshenko supports the need for appropriate improvement of the legislation, but notes that it should be done very carefully. «The law contains provisions that contradict the Constitution and laws of Ukraine, does not create the appropriate legal mechanisms for the implementation of housing rights of residents of hostels and contains risks of violations… In the first place, are unacceptable provisions of law establishing the limitation of constitutional rights of citizens and does not meet the constitutional principle of equality of citizens before the law,» — said in comments on the presidential website.

Thus, the document restricted the rights of citizens who were lawfully residing in the hostels, the privatization of inhabited quarters in the hostels depending on the availability of employment or service relationship with the company or organization that gave them the right to live in a Dorm, or official registration of residence in the hostel.

«The establishment of the unjust rules and the rights of citizens in such a sensitive sphere as the housing relations, could lead to increased social tension in society, but also become a factor of social conflicts. Also the law is not deprived and other imperfect rules, are creating uncertainty in the legal regulation of realization of housing rights of residents of hostels», — stated in the message.

The President stressed that the settlement of legal relations to ensure the realization of housing rights of residents of hostels should be on the basis of the Constitution and laws of Ukraine and needs a more balanced approach than that proposed in the law.

Recall, the Verkhovna Rada of Ukraine 252 votes has approved the bill No. 1076 on amendments to some legislative acts of Ukraine, concerning clarification of the scope and improvement of certain provisions of transfer of hostels in ownership of local communities and ensure the implementation of housing rights of the legitimate inhabitants of hostels on the 20th of April this year.

Under the bill, the dormitory of the state form of ownership are transferred to the ownership of territorial communities to ascompensation basis. The hostel, included in the authorized capital of the society, passed into the ownership of territorial communities in accordance with the law one of the following ways: on the basis of ascompensation dorms are passed with the consent of the owner of the hostel – according to his decision; without the consent of the owner of the hostel – by the court.

After transfer of hostels to municipal property of their legal residents are issued a special order to rule the universe for residential space in the dorms and amount to contracts of employment of residential premises in a hostel, and other citizens residing in such hostels can provide a residence permit in accordance with the Civil code of Ukraine and to draw up a contract of employment (rental housing) in housing premises in a hostel.
