The President of Ukraine Petro Poroshenko has signed a decree, which was dismissed from a post of the judge of Holosiyivsky district court of Kyiv Larisa Kalinichenko for violation of the oath.
As reported on Wednesday, 24 February 2016, the press service of the Ukrainian state, the Temporary special Commission on check of judges found that Kalinichenko during the events of 21 November 2013 to 22 February 2014, taking the decision about election of a measure of restraint in form of detention for a period of 60 days activists of the Revolution of Dignity and the involvement of activists of automaidan to administrative responsibility in connection with the failure by drivers of requirements of employees of militia about a stop of vehicles, grossly violated the requirements of procedural law and demonstrated a biased and prejudiced hearing of cases against such persons.
Also this decree the President dismissed the judge of the district court Drohobych, Lviv oblast Andriy Haiduk in connection with acquisition of legal force in relation to him a guilty verdict.
«The court of appeal of Ivano-Frankivsk region declared Haiduk guilty of committing crimes provided for by part two of article 375 of the Criminal code of Ukraine (the decision of the judge knowingly unjust judgement, decision, ruling or order, which entailed grave consequences or committed for mercenary motives or other personal interests) and the first part of article 366 of the Criminal code of Ukraine (office forgery, that is entering by the official into official documents of obviously false data, another forgery of documents as well as drafting and issuing false documents).
In addition, Poroshenko has dismissed the judge of Ivano-Frankivsk city court of Ivano-Frankivsk region Alexander Boychuk in connection with the expiration of the term for which he is appointed, and the judge of the Luhansk district administrative court Elena Debowo in connection with submission of resignation from the post at own will.
As previously reported, the lustration of judges still remains one of the unfulfilled promises of the ruling in Ukraine Pro-European parliamentary coalition. A number of judges, taking a hard and sometimes cruel decisions against the former democratic opposition and Euromaidan participants, still occupy their positions, and even the most odious of them did not incur criminal punishment.
The head of Ukrainian government Arseniy Yatsenyuk in the summer of 2015 offered fully fire the composition of courts of all instances and specializations, and then update it via «open competition», that is, according to the same scheme, which was established by the national police. The potential to replace about 9 thousand judges working at present in Ukraine, there is, after all, every year domestic graduates 12 thousand lawyers, noted the Prime Minister. Also, according to him, in Ukraine — 40 thousand lawyers and about 10 thousand notaries.
The same subject continued Yatseniuk aired his weekly TV program «10 minutes with Prime Minister» for October 25, saying: in the Venice Commission confirmed the possibility of a phased replacement of the entire judicial system of Ukraine. The next day, Yatsenyuk urged the Verkhovna Rada to support voiced radical judicial reform.
In turn, the Administration of President of Ukraine in the person of Vice President for legal Affairs Oleksiy Filatov is opposed to an approach Yatsenyuk, considering the need to update judges by retesting.
