After the decision of the constitutional Court of Ukraine that the law Kolesnichenko–Kivalov on the principles of state language policy is inconsistent with the Constitution, it has lost its power. About this in comments to the edition «GORDON» said the people’s Deputy from «popular front» Leonid Yemets.
«First of all, you need to study the decision of the constitutional Court. I represent a group of deputies, the legal position which the vote for this law as follows: it was held in violation of the Constitution. As evidence, we provided documents confirming that more than 20 MPs, who then allegedly voted for the bill, in fact at this time were outside of Ukraine. It documents the border patrol, as well as footage of video recording. We know that the Constitution provides for the personal presence of the Deputy in the session hall to have his vote counted. If the law is unconstitutional, it ceases to act. No additional vote is not necessary», – said the MP.
He noted that the court’s decision is not subject to appeal.
«Our opponents disagree with the decision of the constitutional Court according to the law of Kolesnichenko–Kivalova, I can only go and be killed on the wall. It’s the only thing they do, as this decision is final. Appeals can not be here. We have a number of other bills. Therefore, this issue should be approached seriously. Because abolished the law was adopted within the framework of Russian Subversion in Ukraine and was part of the plans of the FSB. I am glad that the abolition of this law occurred after the appointment of a new head of the constitutional Court. How it manifests itself now this court, is really encouraging. I’m happy with the result and the assessment that the court has given our legal position,» said Yemets.
The Verkhovna Rada adopted initiated by the Party of regions the draft law «On principles of state language policy», the authors of which were MPs Vadym Kolesnichenko and Serhiy Kivalov, July 3, 2012. The document came into force in August of the same year and included, in particular, the possibility of official bilingualism in regions where the number of minority exceeds 10%. Opponents of the law have stressed that the document strengthens the position of Russian language in Eastern regions of the country.
In February 2014, immediately after the victory of Euromaidan, Parliament abolished the «law of Kivalov–Kolesnichenko», however, the acting President of Ukraine Oleksandr Turchynov said that he will not sign the Parliament’s decision.
In July 2014 57 people’s deputies filed a submission on the constitutionality of the law in the constitutional Court, on 10 October of the same year, opened the proceedings, in November 2016, the court proceeded to consideration of the views of MPs.
14 December 2016 KSU has completed a trial in open court and passed to the closed part of the meeting.
28 February 2018, the constitutional Court of Ukraine adopted a decision regarding the law on principles of state language policy. In a press-service of the Ukrainian Association «Freedom» argue that the constitutional court recognized it unconstitutional.
