Nye: the anti-corruption court will work only after the presidential elections in 2019

If the adoption of the law on Higher anti-corruption court (WACHS) will go at the same pace as his training, he will not come into force before March and the new authority will start work in 2019. About this in Facebook wrote MP from the Bloc Poroshenko Mustafa Nayem, commenting on the text of the bill prepared by the President of Ukraine.

«The court can be formed in the course of the year since the signing of the bill. To become empowered you need to choose a minimum of 2/3 of judges from its membership. I will remind, the law on anticorodal we waited a year. If its adoption will be as slow, we have all chances to see the signature of the President in March. This means that in fact the anti-corruption court will work only after the presidential elections in 2019,» – said Nayem.

According to him, lawyers of the presidential Administration bypassed the recommendation of the Venice Commission on the decisive role of international experts and donors in the selection of judges WAX. In the President’s proposed text of the international organizations have an Advisory role, said the politician.

«The Council of the international experts will decide on each candidate judge anticorona. But if the expert Council decides that the candidate for judge is not eligible, then… nothing. This decision may be annulled by the Supreme qualification Commission of judges», – Nayem wrote.

He also fears that the bill Poroshenko will allow the WAX to fill up the Affairs not only from the National anti-corruption Bureau, but also from the police, the security Service of Ukraine and Gospitalny service.

The law is written in such a way that, theoretically, the case against top officials, which was conceived antiquorum, can be seen not only by this court,» – says the MP.
