Not as bad as it might seem at first glance – yurchishin about the bill on the anti-corruption court

Submitted to the Verkhovna Rada a draft law of Ukrainian President Petro Poroshenko on the establishment of an anti-corruption court, most likely, will fail to optimize. This opinion in comments to the edition «GORDON» was expressed by Executive Director of Transparency International Ukraine Yaroslav Yurchyshyn.

«If you solve the key problems in this bill, it will quite working. It can be taken in January and February and, most likely, by the end of next year to have the high-grade anti-corruption court. But lately, we see that the Parliament, reviewing the bills, in the end, not strengthens them and weakens. With elections approaching, the Parliament has traditionally become a more politicized. Currently in Parliament there are more than 10 defendants in the investigation to NAB and the GPU. The chances of the optimization of the bill are quite low. On the contrary, it can only worsen,» – said yurchishin.

He stressed that the presidential draft law did not take into account all the recommendations of the Venice Commission.

«The draft bill on anti-corruption court could be appealed against in the constitutional Court. But the presidential no. There’s already all these factors into account. If it will be amended as necessary, it may be adopted in the near future. Not as bad as it might seem at first glance. Before there was debate about anything. Now, we start from the recommendations of the Venice Commission. However, they were not fully taken into account. Yes, the bill is not perfect, but it’s the President’s position. He has every right to it. Just as we may disagree with certain aspects. For example, there is a risk that judges could not cope with the volume of cases that they will consider. But this issue is resolved, you need to either increase the number of judges, or to reduce the number dealt with in this court» – summed up yurchishin.
