A number of people’s deputies of Ukraine and the party «national body» require the adoption of the draft law simplifying the procedure of obtaining Ukrainian citizenship by foreigners who participated in the ATO.
«These people don’t want money or preferences. They want a passport of the country for which they fought and buried their fighting brothers. My colleagues and I filed a bill that partially solves this problem. He was already the Committee’s discussion, there are findings of the expert group is ready to vote,» — said at a briefing on Monday 16 January in Kiev, one of the bill’s authors, MP Oleg Petrenko (the faction «Block of Petro Poroshenko»), reports «Interfax-Ukraine».
He noted that since the beginning of the Russian aggression (April 2014) about 400 foreigners took part in the defense of the territorial integrity of Ukraine.
«About a hundred of them fought in the regiment «Azov», — said the Deputy.
During the briefing was also addressed by several foreigners who took part in ATO as a part of voluntary battalions. They said that at home face political persecution and Ukrainian citizenship would protect them.
On the website of the Verkhovna Rada stated that the bill No. 3433 «On amendments to some legislative acts of Ukraine (concerning the legal status of foreigners and persons without citizenship, who participated in the defense of the territorial integrity and inviolability of Ukraine)», the initiators of which are Petrenko, Andrey Biletsky (independent), Igor Lutsenko (fraction «Fatherland»), was introduced in November 2015.
The document, in particular, provides for amendments to the law «On legal status of foreigners and persons without citizenship», which proposes to establish a definition for the term «participation in the protection of the territorial integrity and inviolability of Ukraine» regarding foreigners and persons without citizenship who have provided practical assistance to the ATO. It is also proposed to admit foreigners and persons without citizenship who took part in the defense of the territorial integrity of Ukraine as such that resides legally on the territory of Ukraine and to provide the opportunity for these individuals to obtain a residence permit in Ukraine at the time of participation in the protection of the territorial integrity and inviolability of Ukraine.
In addition, the bill provides for the establishment of «restrictions on the voluntary or forced return of foreigners and persons without citizenship to the aggressor state or countries do not recognize the territorial integrity of Ukraine or support the aggression against Ukraine.» Also, it is proposed to amend the Law of Ukraine «On citizenship of Ukraine», which proposes to stipulate the norm on the simplified procedure for acceptance in nationality of Ukraine of foreigners and persons without citizenship, provided practical assistance in the protection of the territorial integrity and inviolability of Ukraine.
As reported, in late October 2016 Uzbek Shavkat Muhammad, who fought in Donbas as part of a battalion «Aydar» against the Russian-terrorist forces, was compelled to leave Ukraine due to the fact that he was denied refugee status.
We will remind, the President Petro Poroshenko on 29 March 2016 signed a decree «On amendments to the decree of the President of Ukraine of 27 March 2001 No. 215» that will simplify the procedure of adoption of Ukrainian citizenship to foreigners who serve in the armed forces. According to the law, the military, foreigners can obtain Ukrainian citizenship after three years residence in Ukraine since the start of the contract on service in the Armed forces of Ukraine.
Before, 7 April 2015, the Council recognized volunteers and a number of other categories of combatants (bill No. 1688). The law also envisages to provide the right to establish the status of combatant persons who are part of the volunteer units of the territorial defence, which was created by the state or public organizations, or organized themselves to protect the independence, sovereignty and territorial integrity of Ukraine, took part in anti-terrorist operations, ensuring its implementation, while in areas of the ATO in the period of its implementation, provided that such further voluntary formation and self-organization was the inclusion of the APU, the interior Ministry or the national guard.
