The Pechersky court of Kiev has banned a number of Telecom operators to manage the information needed to investigate crimes committed during the Maidan. MTS Ukraine (Vodafone), lifecell, Ukrtelecom and its mobile subsidiary Trimob has been instructed to keep all records of calls and messages for the period 18 Jan 2014 to 16 Mar 2014.
The legislation requires operators to keep records of all supplied Telecom services in the next three years. Because the limitation period has to end soon, the Prosecutor General’s office (PGO) appealed to the Pechersky court with a request to forbid the operators to destroy the necessary to investigate the data.
The Department of special investigation GPU is investigating the crimes of the President-the fugitive Yanukovych under article 255 of the Criminal code «a criminal organisation». In the judgments of the court mentioned in particular that a certain person has committed a crime «… with the aim of seizing power… that led to mass casualties among the protesters…» Therefore, the Prosecutor General’s office had «substantiated the necessity of preserving intact information» for a specified period, which is stored on servers and hard drives listed operators.
Thus, the Department of special investigations of the Prosecutor General will be able to access all incoming and outgoing calls and text messages, as well as data on the location of the subscriber numbers in the period.
The publication surveyed Telecom operators assured that they will abide by the decision of Pechersky court and that it would have no impact on their operations and customer service. «The investigation of the Prosecutor General concerning the executions of people on Maidan. Ukrtelecom and Trimob, in accordance with applicable law, will fulfill the court’s decision. In lifecell are unable to comment as the press service of Kyivstar announced that such court decisions, the company did not receive.
