Lutsenko signed a document prohibiting violations of the rights of business during the searches

October 5, the Prosecutor General of Ukraine Yuriy Lutsenko has signed a letter of orientation on the prevention of violations of the rights of businesses when conducting searches, the press service of the Prosecutor General.

According to the document, to the approval of the requests of the investigators on obtaining court permission to conduct a search procedure, managers are required to investigate the need for the involvement of special forces. If it is necessary, they must coordinate this with the heads of regional Prosecutor’s offices.

It is noted that the involvement of the special forces during the searches permitted in criminal proceedings for grave and particularly grave crimes and in case of resistance to investigations.

In the letter the attorney General said that prosecutors have during the searches to ensure the proper implementation of the requirements of the Criminal procedural code of Ukraine, in particular, to record their conduct by means of video recording, to ensure that the admission of lawyers even after the beginning of the search, to present a resolution on the permission to search and provide copies of it.

According to the document, the temporary seizure of computer equipment, parts, mobile communications, devices or other media permitted only in cases when it is necessary for the expert study or if there is information that the equipment received through the Commission of a criminal offence or is a tool or a weapon it was committed.

«Anyone who would flagrantly violate this order, will feel it at least on the salary», – Lutsenko declared, by signing the letter.
