Kyiv district administrative court has frozen the preparations for the elections of local councils

District administrative court of Kyiv has stopped the preparations for the local elections in the capital on March 27, would have to determine the composition of district councils.

As reported in Department of interaction with mass media of the Secretariat of the CEC, such a conclusion is contained in the explanation, which the court accepted on Friday 5 February in response to the appeal of the CEC to clarify the essence of the decision dated 27 January 2016, which was suspended the CEC decision on the beginning of the electoral process the first elections of deputies to district councils of Kyiv on March 27, 2016, reports «UKRINFORM».

In particular, the Commission noted that on January 27 the District administrative court of Kyiv satisfied the petition of public organization «public control «EMERY» and actually banned the CEC to organize the local district elections in the capital.

The CEC appealed against that decision that the court itself decided to consider only 11 of February of this year.

But in accordance with the requirements of the electoral legislation, the CEC must complete its work on the formation of election commissions on the organization of elections in the regions of Kiev, on February 7 this year. For the avoidance of legal conflicts, the CEC has applied to the court for clarification of its decision of 27 January, and at the same time beginning work on the formation of district election commissions.

«District administrative court of Kyiv in its ruling of 5 February 2016 explained that in connection with the suspension of the Ordinance of the CEC №621 dated December 25, 2015 «About the beginning of the electoral process the first elections of deputies to district councils of Kyiv on March 27, 2016″, the Central election Commission and other election commissions must refrain from taking actions pursuant to the suspended regulations associated with the beginning of the election process, preparation and conduct of elections of deputies of Raion in Kyiv boards January 27, 2016, including those associated with the formation of new district in the city of Kiev of the election commissions, registration of candidates for deputies of rayon in Kyiv city councils, financing of preparation and conduct of elections and so forth,» — said in explanation.

The CEC refrained from assessments, does this explanation of the court «de facto» abolition of elections to the district councils: «We brought these orders (court) to the public. So far, the court’s decision prohibited the activities of any election commissions on the organization of the district election in Kiev on March 27. We will wait for the review by the court of appeal of the CEC, to be held on 11 February. If adopted on 27 January, the court’s decision will be cancelled on 12 February, we will still be able to resume work on the formation of district election commissions in the city of Kiev».

We will remind, on 23 July, the Council adopted a decision «On the management of the city of Kiev.» The document establishes that management of areas in Kiev is carried out by district councils. Also by this decision the deputies formed goloseyevsky, Darnytskyi, Desnyanskiy, Dniprovsky, Obolonsky, Pechersky, Podilsky, Svyatoshynsky, Solomyansky, Shevchenkivsky district councils.

In the case of elections to district councils of Kyiv in the capital may further appear from 462 to 474 new members.

Secretary of Kyiv Council Volodymyr Prokopiv convinced that Kyiv is not ready to return district councils.

The Central election Commission appointed on March 27, 2016 elections of deputies to district councils of Kyiv. The beginning of the election process announced on 6 February 2016.

The Committee of voters of Ukraine believes that the district councils in the cities is a relic of the Soviet system and the elections to them are not needed.

January 27 the District administrative court of Kiev suspended the elections of regional councils in Kiev. The CEC was intended to appeal.

On 29 January the representatives of 7 political forces have signed a joint letter to the President asking him to ensure that elections in the district, city councils of Kyiv on March 27 and applied to the General Prosecutor and the National anti-corruption Bureau.

February 1 the representatives of the democratic political forces jointly filed the registration documents of the members of the district in Kyiv city election commissions to the Central election Commission.

District councils in the capital was abolished in 2010.
