«With language that was adopted by this law («On State Bureau of investigation» – ed.) since March 1, we may terminate the investigation of the Maidan and Affairs of high-ranking officials,» he said today, January 21.

He called at the next session of the Verkhovna Rada to amend the law and offered the assistance of the Prosecutor General on the drafting of the bill.

According to the Gorbatyuk, the very State Bureau of investigation as a body «was created only in order to report to Europe that we made it as written the bill is not perfect and does not bear any load to be borne by this authority.»

In particular, he recalled that at the last moment from the law were removed without any discussion on the norms on the investigation of organized crime, murder.

«It (the state Bureau of investigation – ed..) becomes committed an empty body, it really needs a lot of work,» — said Gorbatyuk.

Previously, Mr. Yan said that the law on National anti-corruption Bureau two years block the investigation against the officials involved in crimes against Euromaidan.

Yatsenyuk will discuss the launch of the state Bureau with the President

Prime Minister of Ukraine Arseniy Yatsenyuk doubts that since March 1, the State Bureau of investigation (UIR) will be able to get to work, and is going to discuss this issue with President Petro Poroshenko.

«I strongly agree with you that on March 1 the State Bureau of investigation will not work, because we are not even competition will hold. And even if theoretically assigned to a supervisor, it does not mean that we immediately get the entire state on open tenders», — he said at a meeting on anti-corruption investigations on Thursday in Kiev.

Yatsenyuk said that he was going to discuss the issue of starting RRT with the President. «The President and this issue will discuss, and your position (representatives of the security agencies present at the meeting – ed.) in part of the reality of starting RRT by a set of people is important,» he said.

The Prime Minister also instructed the Minister of justice Pavel Petrenko to conduct an interagency meeting on the topic of the reality of the timing of the launch of the RRG.

Heads of power structures appeal to keep the investigative process

Among the heads of law-enforcement and power structures of Ukraine there was discussion regarding the date of start of work of the State Bureau of investigation (UIR) and mechanisms to ensure continuous investigation of criminal proceedings.

The Minister of justice of Ukraine Pavlo Petrenko during the meeting on anti-corruption investigations involving law enforcement agencies said that one should not delay the launch of the RRG.

«This new body (State Bureau of investigation – ed.) provides for the formation of the investigators under the new procedure. Don’t be afraid of change. And we are ready to help you in this direction and is ready to address Parliament and the President, that was urgently formed a Committee for the election of the management of the RRG. And the Prosecutor’s office, and other law enforcement agencies should be prepared to ensure that this body is earned», — said Petrenko during the meeting on anti-corruption investigations involving law enforcement agencies on Thursday.

He said: «I will allow myself to disagree with the position of the prosecution that it is necessary to indefinitely postpone the law on the State Bureau of investigation. It is necessary to unite and solve the problem – to launch this new extremely important organ».

In turn, the head of the Department of special investigations of the Prosecutor General of Ukraine Serhiy Gorbatyuk noted that this situation characterizes the phrase «good intentions paved the road to hell».

«In itself the desire to fulfill the Constitution (as regards the deprivation of the prosecutors of the functions of the investigation – ed.) in a way that is happening now, will lead to the elimination of the process of the investigation,» expressed the opinion of the representative of the Prosecutor General.

He warned of a possible repeat of the situation that has arisen with the National anti-corruption Bureau of Ukraine (NABU), for the operation which was not anticipated transition period and a half month «the investigation was».

«And now, before the entry into force of the law, I warn everyone that this situation could be repeated, and we must do everything so that, in order to achieve a good purpose, not to harm. Relatively speaking, is undergoing an operation, the doctor stands near the patient – the investigator near the case – and we take it from the doctor and say, stand in line and go to take the exam,» — said Gorbatyuk.

The Minister of internal Affairs of Ukraine Arsen Avakov partly shared the opinion of the representative of the Prosecutor’s office, stressing: «I understand what you’re talking about. You’re talking about a real mechanism for ensuring the ongoing process, and in this sense the law on the RRG requires clarification, of course, it requires that we entered the Parliament in the coming days.»

The head of the SBU Vasily Gritsak noted the importance of ensuring the continuity of the investigation of criminal proceedings.

Addressing the Minister of justice, he said, «Pavel, we are not against the creation of (UIR), on the contrary, we over – passed laws, they should be performed. We’re talking about the fact that March 1 will come just soon. We will be ready to transfer all criminal proceedings – the Prosecutor’s office in the newly created Bureau and there will also be staff? We’re talking only about the creation of the Commission on selection (frames)».

«We cannot ensure the continuity of processes. It is very important that we are not in a hurry for 30 days completed the RRG, which will consist of the best shots», — said Hrytsak.

The Verkhovna Rada adopted the law on the State Bureau of investigation November 12, 2015.

January 15, 2016 Poroshenko has signed the law.
