Gorbatyuk: Changes in legislation in 2014 led to the fact that the Berkut officers who have committed crimes can get an acquittal

In 2014, the criminal code of Ukraine was amended, which ex-Berkut officers suspected of committing crimes on the Maidan in Kiev in 2013-2014, unable to get an acquittal. This was stated by the Director of the Department of special investigations of the Prosecutor General Sergei Gorbatyuk in the program «BATMAN» editor-in-chief of the edition «GORDON» Alesya Batsman on the channel «112 Ukraine».

«I think lustration was carried out imperfectly, as it often happens in the country: good idea meets bad execution, or any changes at the last moment, someone on the sidelines makes. And I see that we have the Verkhovna Rada has such a rule, first adopted one law, and then someone else modifies. Such a situation occurred, for example, with the same judicial reform: while the law has not been published, I couldn’t find his version, which went from the Verkhovna Rada, not to mention the one that was voted on. And this is not an isolated case. It started in 2014, when changes were made to the criminal code with respect to the notes of article 364, in which all abuses, of abuse of authority of public officials, law enforcement becomes a crime only when material damage,» – said Gorbatyuk.

In his words, «changes, according to the results of the inspection were made after the law was voted.»

«To date, on the basis of practice of the Supreme Court, these changes have led to the fact that those same Berkut officers who committed crimes envisaged by article 365 (abuse of power, from which victims were injured, but no material damage), can obtain an acquittal. For other crimes there are already several such decisions of the Supreme Court. And it’s made by the hands of the Verkhovna Rada,» – said Gorbatyuk.

At the end of 2013 – early 2014 in Ukraine there were mass protests that led to regime change. The protesters resisted law enforcement authorities and hired armed bandits (titushki).
