The Verkhovna Rada of Ukraine allowed to apply for parole of persons sentenced to life imprisonment. Bill No. 2292 «On amendments to some legislative acts of Ukraine concerning the replacement of life imprisonment with a more lenient punishment» on Thursday, 26 November 2015, was supported by 223 MPs, informs «RBC-Ukraine».
Provides that the person serving punishment in the form of lifelong imprisonment, can be applied to probation, if the court recognized that such a person does not need the further serving of this punishment and has actually left not less than 20 years imprisonment.
The law provides that a conditional release from further serving of punishment in the form of life imprisonment is applied only in the absence of the convicted person’s willful violations of the established order of serving of punishment in the last three years. In the case of pardon, life imprisonment can be replaced by a term of 25 years.
It is emphasized that lifelong imprisonment for preparation for a crime and attempted crime can not be applied.
Provides that the President may apply to the parole rule about replacement of punishment or the unserved part of the punishment imposed by the court, on softer. A petition to pardon a convict is entitled to submit, his / her counsel, legal representative, close relatives and human rights organizations, including international ones.
After an early release of the citizen for it is proposed to establish administrative supervision for a period of 10 years.
We will remind, the Parliament passed the bill in first reading on 12 may.
The authors of the bill noted that the possibility of early parole for «life» is a European practice that should be applied in Ukraine.
