The Antimonopoly Committee of Ukraine adopted a decision to fine «Gazprom» to 85,9 billion hryvnias for violation of the legislation on protection of economic competition.

As noted, upon review of the case, the Committee adopted a decision which recognized that «Gazprom» in the period from 2009 until 2015, as the buyer takes a monopoly (dominant) position on the national market of services on transit of natural gas through main pipelines through the territory of Ukraine.
«The essence of the violation consists in the omission of OJSC «Gazprom», which was the failure to secure the receipt of services on transit of natural gas through main pipelines through the territory of Ukraine on reasonable terms would not have been possible in the conditions of existence of significant competition in the market, and has led to infringement of interests of the NJSC «Naftogaz of Ukraine», — stated in the message.
For the committed violation at Gazprom fined in the amount of 85,9 billion hryvnia.
In addition, the decision Committee of the Russian Gazprom is obliged within two months from the date of receipt of the decision to cease the violation.
«To fulfil the obligations the defendant may use any lawful method, in particular, negotiations with NAK «Naftogaz of Ukraine», the results of which should be set reasonable conditions for the acquisition and implementation of services on transit of natural gas through the territory of Ukraine, including, having regard to the Treaty establishing the Energy Community», — says the press service.
OJSC «Gazprom», which is fined by the decision of the Antimonopoly Committee, shall pay him within two months from the date of receipt of the decision imposing the fine.
Also «Gazprom» has the right to appeal the decision of the Antimonopoly Committee fully or partially to the economic court within two months from the date of receipt of the decision.
Recall, 22 January 2016, Gazprom was fined by the Ukrainian Antimonopoly Committee 85 billion (3.4 billion U.S. dollars) for abuse of dominant position on the market of transit of gas through Ukraine.
As said the Deputy Chairman of the Antimonopoly Committee of Ukraine Mariya Nizhnik, NJSC «Naftogaz of Ukraine» has the right to demand from «Gazprom» double compensation for damage in connection with the monopoly violations during the transit of gas.
«The decision of the AMCU cannot be considered otherwise than an attempt to exert pressure on Gazprom, commented on the same day in Moscow.
