All judges of the Pechersk court refused the case of Ephraim

Pechersk district court of Kyiv asks Appeals court of Kyiv to change the territorial jurisdiction of the case against the former deputies of the Verkhovna Rada Alexander Efremov, Alexander Stoyan and Sergey Gordienko. I «Ukrainski Novyny» the lawyer said Gordienko Alexander Easy.

«Today the panel of judges sent the case back to the Appeals court for change of venue,» he said.

This is due to the fact that at the meeting on Friday, 26 February, all the judges recused himself.

Thus, in the Pechersk court does not have judges who might review the corresponding criminal proceedings, the Agency said.

We will remind, on July 21, the Prosecutor General’s office completed investigation against Ephraim, Stoyan and Gordienko, suspected of abuse of power and falsification of procedure during the adoption of «dictatorial laws» 16 of January 2014.

On February 16 the Pechersky district court of Kiev chose Yefremov the measure of restraint in form of detention, but the ex-Deputy was released on bail of 3.7 million hryvnia. Bail for Yefremov introduced former Deputy Prime Minister Boris Kolesnikov.

Ephraim charged with suspicion of two criminal proceedings. One of them concerns the abuse of authority under aggravating circumstances and official forgery (referring to the adoption of «dictatorial laws»), and the second of the sayings of Ephraim in the spring of 2014, aimed at incitement of national hatred, which led to serious consequences in the form of loss of life.

November 30, 2015, the Pechersky district court of Kyiv returned to the Prosecutor’s office indictment against former people’s deputies of Ephraim, Stoyan and Gordienko in the case of voting for «dictatorial laws» 16 of January 2014. The corresponding decision was made by the panel of three judges, explaining that the indictment does not meet the requirements of the Criminal procedural code of Ukraine.

On 14 January the Appeal court of Kiev has satisfied the claim of Prosecutor Valery Zimoglyad and returned the proceedings in the Pechersk district court of Kyiv .

Yefremov denies the charges.

Note that adoption of «dictatorial laws» has led to a sharp escalation of tensions in the society during the Euromaidan protests.
