After the incident with Pashinsky MPs want to extend the norm on self-defense

The Verkhovna Rada registered a bill that expands the list of facilities for which the owner may avoid criminal liability during the defense in case of attack on such facilities.

About this in comments to UKRINFORM said the author of the bill Ihor Lutsenko (faction of political party «all-Ukrainian Union «Fatherland»).

In particular, he explained that the bill proposed to clarify a rule about the tenure for which you can apply self-defense.

«Possession implies not only some room. May, for example, be a vehicle. By analogy with a house: if it breaks, it is possible to use weapons and cause damage to the attacker etc…that is more advanced protectivna rule, which already exists, which is successfully used on it and no complaints. We only disseminate it to other types of property, not just real estate,» — said the Deputy.

Igor Lutsenko said that the draft law No. 5609-1 «On amendments to article 36 of the Criminal code of Ukraine regarding the definition of self-defense» was in connection with the incident involving the people’s Deputy of the Verkhovna Rada from the «popular front» Sergei Pashinsky.

As reported, on 31 December 2016 in one of the villages of the Vasilkovsky region of Kiev region on the road between Pashinsky and a local resident the incident occurred, during which the Deputy used firearms and wounded his opponent. According to Pashinsky, the man with the bottle attacked first, and he did the first warning shot.

However, Vyacheslav Himikuswho was shot Pashinsky said that the MP did not do a warning shot in the air and was aiming at the chest.

MP on Tuesday, January 10, visited the Prosecutor’s office for questioning in the case on new year’s eve shooting.
